Adoption Contract

This Agreement between (Buyer)______________________________________ and (Seller) Jody Hewitt of Dreamers Legacy Cattery is effective as of the date of the last signature to appear below and is binding upon all parties thereto. As to the below described cat/kitten pursuant to all of the following terms.

Pet Quality
1. If sold as a pet, the kitten/ cat shall not at any time be bred.  The (Seller) will not be held responsible for how a pet quality kitten/ cat develops.  Kitten/ cat sold as pets must be Neutered/ Spayed no later than 6 months of age and a letter from the Vet must be supplied to the (Seller) within 3 months of alteration surgery. Until such time the Registration papers from TICA will be withheld by the (Seller.) 
(Seller) reserves the right to confiscate  kitten/ cat if proof of Spay/ Neuter is not provided to the Seller by 9 months of age with no financial return.

Breeder Quality
2. If sold as having breeding potential, the kitten/ cat may only be mated to a suitably TICA registered cats and any resulting kittens shall be reared, vaccinated and sold or Re-homed in accordance with TICA guidelines. No responsibility can be accepted by the (Seller) should the kitten/cat fail to succeed as a breeding adult. _______

Show Quality
3. If sold as having show potential, the (Seller) cannot guarantee the success of the kitten/cat in competitions including no guarantee to the size, markings or colorings of cat at maturity.

The Buyer
4. Assumes responsibility of all expenses incurred in relation to the cat/kitten after leaving the possession of the (Seller) as well as any expense incurred at the request of the (Buyer) before the cat/kitten leaves possession of the (Seller.) If for any reason the cat/kitten is returned to the (Seller), (Buyer) agrees to pay all expenses, including shipping costs, mileage and re-examination expense at (Seller's) veterinarian. (This examination will include a complete viral panel blood test FELV, FIP, and HIV viruses.)

Refunds and Expenses
5. There shall be no refund or replacement unless under the Health Guarantee (6.)  There will be no refunds of purchase price, shipping charges, or other costs. (refund Within the 72 hour period only)

Health Guarantee
6. Dreamers Legacy Cattery (Seller) guarantees the health of said kitten/cat upon pick-up from the cattery or upon the time of shipment for a period of seventy-two (72) hours.  This time period begins ________________ or at the point of receiving shipped Cat/ Kitten. The cat, if shipped, comes to you with a record of vaccinations. We recommend that you take the cat/kitten to your own veterinarian within the first 72 hours. (At the Buyers expense.)  Quarantine the kitten/cat during this time and follow the advise of your own veterinarian. You or your veterinarian, shall report to the (Seller) any medical problems (within the 72 hour period only) Failure to make this report within this time frame will void this warranty. If the cat/kitten is found to be of unsound health by a licensed veterinarian, the cat/kitten will be returned to (Seller) and (Buyer) may request a refund or replacement with another cat/kitten of equal value. Said replacement will be made as soon as a suitable replacement becomes available. A medical report signed by the examining veterinarian must be provided to the (Seller) prior to a refund/ replacement being made. The Seller will not replace any cat or kitten that has not received adequate or appropriate Veterinary and personal in homecare from its new owner.

a.) Unsound health shall be defined as any condition which is a congenital birth defect and is life threatening, This shall not include conditions or infections such as Colds, Virus (including FIP) , Bacterial infections of any kind, or Skin or Fur ailments. Parasites that infect the intestinal tract (including Giardia, Coccidiosis Trichinomas)

b.) Should the cat/kitten die within six (6) months as direct result of an unknown 
(at the time of sale)  from a congenital birth defect, kitten/cat will be replaced only if an appropriate Necropsy is performed by a licensed Veterinarian and there is full written report (all tests included) on the Veterinarian Letterhead with the cause of death. (Buyer) must also include the Veterinarian contact phone number.  Replacement will only be made after the (Seller) follows up with said Veterinarian  and confirms cause of death. Trauma, abuse or neglect will void the guarantee.

Vaccinations
7. Your cat/kitten has been given the required vaccination series, excluding FIP vaccine. We pride ourselves in raising healthy, vaccinated, kittens. At the time said cat/kitten leaves our cattery, to the best of our knowledge, in healthy condition. However, in the event that said cat/kitten should be diagnosed with a condition, this would not qualify for a replacement. No responsibility can be accepted for any illness occurring after purchase for any stress related symptoms, from traveling or exposure to cats or their illnesses on the buyers end.

Warranty Void If FIP Vaccine Given
8. We do not recommend vaccinating this cat/kitten with the FIP vaccines. These Vaccines are not safe for any breed. Reference: Feline Infectious Diseases, Chapter 7, page 54, (first column-last paragraph). Written by Niels C. Pedersen, D.V.M. Ph. D. 
All Cats carry the Corona Virus in one variation or another. Feline Infectious Peritonitis (FIP) is caused by a Corona Virus that can infect any cat. In any event that said cat/kitten should be diagnosed with FIP/ FIPV with or without the introduction of the vaccine and it causes death of said Cat/ Kitten this would not qualify for a replacement.

Shipping
9. Costs including health certificate and crate required for shipping are to be paid by the (Buyer,)  Cat/kitten will be shipped Prepaid Freight Only. The cat/kitten must be at least three months of age for this blood test and to fly. (Payments will only be excepted if it is cash or cashiers check or personal check and must clear my bank account prior to shipping this may take up to 2 weeks to process.) Specific shipping arrangements will be made in advance and confirmed to (Buyer) by (Seller,) with the kittens/cat best welfare in mind. This signed agreement must be returned prior to cat/kitten being shipped.

Notification
10. Any kitten/cat from Dreamers Legacy shall not be sold or re-homed by the (Buyer) without the (Sellerâ€™s) Jody Hewittâ€™s prior knowledge. The (Seller) reserves the right to take the kitten back should a situation arise with the (Buyer) where they are unable to keep the kitten/ cat.  If it is impractical for the kitten to be returned to the (Seller) Dreamers Legacy will participate in finding a new home if it is in the best interest of the kitten/ cat, and only if you do not have someone to take the kitten/cat such as a friend or family member.

Deposits
11. The goal of Dreamers Legacy is to place our kittens/cat in loving homes in a timely manner so they bond with their new families. If a kitten/cat is held specifically for a (Buyer,) a change of mind can quite often jeopardize the chance for that particular kitten to be placed in a home while still at a desirable age. Once you have chosen your kitten a deposit of $200. 00 will be required. (non refundable, but deductible off the final payment ) The remainder of the total cost ($) of your kitten/cat must be made in full and must be received before Shipment or Pick up of any kitten.

Venue/ State Law
If any legal action is commenced by (Buyer) or (Seller) as a result of this contract, The (Buyer) agrees that the place of venue for such action shall be Maricopa County, Arizona. (Buyer) assents to personal jurisdiction within such venue regardless of their place of residence and agrees that any judgment obtained is enforceable within the jurisdiction that they reside in as if obtained within that jurisdiction.
Only Arizona State law is enforceable with any legal action by the (Buyer) or (Seller) in conjunction with this contract.

Facsimile/ Email Signatures
A facsimile/ Email signature shall be enforceable as an original if the original contract is lost, destroyed, or otherwise unavailable.

Terms
The use of the terms cat/kitten presents the same as the plural cat/kittens, in the case of more than one cat/kitten being purchased under this sales agreement. I agree to all terms as stated herein.
